The NBA’s investigation into the Los Angeles Clippers and Kawhi Leonard may not be resolved until 2027, with ESPN reporting the probe could extend into next year if the league and the involved parties cannot agree on the investigation’s findings or any proposed disciplinary action.

The lengthy investigation centres on allegations that the Clippers circumvented the NBA’s salary cap through Leonard’s endorsement agreement with the now-bankrupt company Aspiration. The Clippers and owner Steve Ballmer have consistently denied any wrongdoing.

Why the Investigation Is Taking So Long

According to ESPN, the NBA’s investigation is being led by law firm Wachtell, Lipton, Rosen & Katz and could continue into 2027 if the league, the Clippers and the National Basketball Players Association (NBPA) are unable to reach agreement on the findings or any resulting penalties.

Should the NBA determine there is sufficient evidence of salary cap circumvention and all parties agree on the outcome, the matter could be resolved without arbitration. However, if the league seeks punishment and the NBPA disputes the findings, the case could proceed to arbitration, significantly extending the timeline.

Allegations Remain Unproven

The investigation stems from allegations that Leonard received a US$28 million endorsement deal with Aspiration that was used to provide additional compensation outside of his NBA contract.

The NBA has been examining whether the arrangement breached the league’s salary cap rules. The Clippers have repeatedly rejected the allegations, describing them as false, while Ballmer has also denied any involvement in structuring Leonard’s endorsement agreement.

Importantly, no findings have been announced and no penalties have been issued against either Leonard or the Clippers.

Potential Penalties Could Be Significant

Under the NBA’s Collective Bargaining Agreement, teams found guilty of salary cap circumvention can face severe sanctions.

According to ESPN, possible penalties include fines of up to US$7.5 million, the forfeiture of draft picks, the voiding of player contracts and suspensions of up to one year for team personnel involved in any violation.

Despite those possibilities, ESPN reported that league sources stressed penalties would not be pursued without sufficient evidence. The NBPA has also indicated it would challenge any punishment it believes is unsupported.

Adam Silver Wants Resolution Before the Season

NBA commissioner Adam Silver has previously expressed hope that the investigation would be completed before the start of the new season, acknowledging it has taken longer than anticipated.

However, ESPN’s latest report suggests that timetable may prove difficult to meet if the investigation proceeds to arbitration.

Until the league reaches a conclusion, uncertainty will continue to surround both Leonard and the Clippers, with one of the NBA’s highest-profile investigations showing no immediate signs of coming to an end.
